Fair T&Cs

Adverse & Extreme Weather Conditions:

The Melbourne Ceramic Fair is an all-weather event and outdoor stallholders must be prepared for adverse weather conditions. However, in the event of an extreme weather forecast the fair may not operate the outdoor area to ensure the safety of stallholders and market patrons. An email will be sent to the provided email address to announce the cancellation of outdoor spaces.  It is also possible that the event may need to close the outdoor spaces early due to extreme weather conditions- if this is to occur, event staff will notify stallholders directly.

Please keep an eye on your emails for up-to-date information prior to, and on fair day.

Melbourne Ceramic Fair will not be responsible for any loss or damage whatsoever in the event of cancellations/reduced hours due to extreme weather conditions. Melbourne Ceramic Fair will not be responsible for any loss, damage or injury whatsoever due to adverse conditions.

Refund of fees:

If provided with 14 days written notice prior to event, Melbourne Ceramic Fair will issue a refund for stall holders's fees less non-refundable deposit. No refunds are available when less than 14 days written notice of cancellation is provided. 

Please note that no refund is available in the event of reduced outdoor trading hours due to extreme weather conditions.

Fair Days

Stallholder instructions with details of bump-in and bump-out will be emailed to each stallholder two weeks prior to event.

REGULAR trading hours: 10am until 3pm.

Bump in – 7:00am – 9:00am. Strictly no cars are to be moved onsite after 9.00am. Stallholders should ensure that they are ready to trade by 10.00am.

Bump out – 3:15pm onwards. Stallholders are strictly forbidden to commence pack-up until after 3pm. Cars are not permitted to move in the forecourt area until 15 minutes after closing time.

General safety

All Stall equipment must be sturdy and secure and not at risk of injury or collapse. All stall equipment, props and advertisement must be contained within the stall boundaries. 

Stallholders must be aware of stall entry and egress and prepare their stall plan accordingly. Stall holders must maintain awareness of their neighboring stalls and not impinge on their spaces, though collaboration and negotiation between stalls is welcome and encouraged.

Outdoor marquees and all stall equipment must be erected and weighed securely at all times. Stallholders are not permitted to peg their marquee into the ground, a minimum of 20kg per leg must be used to weight the marquee.

All equipment must be in good repair and be operated in a safe manner. All stallholder equipment must remain within the stall site. For the safety of others, public access ways must remain clear at all times.

Event and venue staff will be inspect stallholder equipment at the event.  Any directives issued by event or venue staff  in relation to stallholder equipment / set-up must be adhered to in full.

Occupational Health and Safety

Stallholders are not permitted to drive vehicles within the forecourt area 30 minutes prior and 15 minutes after the markets advertised trading times. Please note: onsite venue area speed limit is 10 kph.

Sustainability Policy

Stallholders acknowledge it is the sustainability policy of Northcote Town Hall Arts Centre and Melbourne Ceramic Fair

+ to use recycled or recyclable packaging
+ to promote the disposal of all waste in an environmentally friendly manner
+ that the fair is free of single-use plastic bags and plastic straws and these must not be offered to patrons in any capacity.

Code of Conduct:

Stallholders must comply with all the terms contained in these regulations and must comply with any changes to the event regulations, or any relevant local government and other statutory laws and regulations. Stallholders must report to the Melbourne Ceramic Fair any incident or accident to any person or property that involves loss or could be expected to give rise to a claim.

Stallholders must not cause damage, make alterations or additions, of any nature to, or carry out works of any nature to the event site property, and that, if any damage is caused, the costs of any repairs, making good or replacement are borne by the Stallholder.

Social Media Policy

Stallholders must refrain from communicating anything on any social media platform that has the potential to damage Melbourne Ceramic Fair's reputation, brand image, commercial interests, or the confidence of our customers.

Stallholder indemnity

Without limiting the generality of any other provisions contained in these Terms & Conditions, the stallholder hereby indemnifies and holds the Melbourne Ceramic Fair harmless from and against all claims for loss arising in connection with or in relation to:

+ The Stallholder’s occupation of the event;
+ The sale or attempted sale of the products approved by the Melbourne Ceramic Fair, or any other products and services;
+ Any injury or harm suffered by the Stallholder, its agents or employees;

+ Any injury or harm caused to any property or suffered by any person as a direct or indirect consequence, in whole or part of any act or omission by the Stallholder;
+ Any loss or damage to the Stallholder’s property regardless of the cause of that loss or damage;
+ The death of any person as a consequence, in whole or in part, of any act of omission by the Stallholder;
+ Any breach of these Terms and Conditions by the Stallholder;
+ Any legal costs in a full indemnity basis incurred by the Melbourne Ceramic Fair as a result of the Stallholder’s breach of these Terms and Conditions;
+ Theft or damage of products, equipment or goods under the control of the stallholder;
+ Any journey by the Stallholder to and from the event; or
+ Damage or injury to any property or person.

Disclaimer

The Stallholder acknowledges and agrees that Melbourne Ceramic Fair makes no warranty or representation in relation to or in connection with the stallholder’s occupation or use of the event. Without limiting the generality of this clause, the Stallholder acknowledges and agrees that Melbourne Ceramic Fair has made no warranty or representation to or in connection with:

+ The prospects of the Stallholder for selling products at the Fair;
+ The Stallholder’s access to people visiting the event or the access those people have to the Stallholder;
+ The existence or number of products that will compete with the products for the attention of the prospective buyers;
+ The existence or extent of services and/or facilities of any kind at the Fair;
+ The position within the event that each stallholder will occupy;
+ The suitability of the event for any particular purpose or the existence of any latent or patent defect at the Fair;
+ The extent, if any, to which other visitors to the Fair might interfere with the Stallholder’s use of the Fair;
+ The existence or extent of any advertising or promotional activity or material that may or may not be published or undertaken by Melbourne Ceramic Fair;
+ The existence or extent of any security measures undertaken to protect the Stallholder, the Products and/or the Fair against criminal activity; or
+ The existence or extent of any security at the Fair

Termination

Any stallholders who do not adhere to these terms and conditions may forfeit any future rights to participate at the events managed by Melbourne Ceramic Fair regardless of any monies paid.
